Late Applications

Missed the EUSS Deadline? We Can Still Help.

If you missed the original EUSS deadline of 30 June 2021 (or 31 December 2020 for most non-EU family members), you may still be able to apply. Late applications are accepted where the applicant can demonstrate reasonable grounds for not applying by the deadline.

Frequently Asked Questions About EUSS

Yes, you may still be able to apply through a late application. The Home Office will accept late applications where you can demonstrate reasonable grounds for not applying by the deadline. Common reasonable grounds include lack of awareness, vulnerability (such as homelessness or domestic violence), language barriers, and digital exclusion. We specialise in drafting these reasons and have a strong track record with late EUSS applications.
Pre-settled status is granted if you have lived in the UK for less than 5 years. It is valid for 5 years and allows you to build up to 5 years of continuous residence to then apply for settled status. Settled status is granted if you have 5 or more years of continuous residence in the UK. It gives you indefinite leave to remain and the right to apply for British citizenship after 12 months. We can assess which status you qualify for.
Yes. Non-EU family members (such as spouses, civil partners, children, and other dependants) of eligible EU citizens can apply to the EUSS as family members. This includes family members who were in the UK before the end of the transition period and those joining from outside the UK. An eVisa is a digital record of your immigration status, replacing physical documents such as biometric residence permits (BRPs). The UK is moving all immigration records to eVisas. If you have pre-settled or settled status under the EUSS, you will need to access your eVisa online to prove your rights in the UK. Most straightforward EUSS applications are decided within a few weeks. However, late applications can take considerably longer as the Home Office needs to assess the reasonable grounds.
